Japanese law has many problems but I'm not sure it's actually more favourable. I've lost track of who is being suggested to sue who over what, but not paying wages or suspending someone without a really solid cause is something the Japanese courts will rule against (although they tend to only award actual damages), and they're not super eager to enforce non-competes.including more favourable employment laws for them.
All of them pretty normal for an employment dispute though? Bad employers put layers of bullshit in their contracts all the time, the court will be used to that and will cut through it. If you could get out of your obligations by incorporating overseas and putting a few lines in the contract, everyone would do it.even for those exemptions she would first have to argue that she is an employee and not a contractor. We're like five arguments deep before she can get her actual case heard.

As far as we have been able to ascertain, from leaks and insider info, Nijisanji gets all the money (after Youtube takes its cut), then gives the liver their cut of the funds (which is a fraction of the total). Its not like the donations go right to the liver's bank account; Niji controls the accounts. Same with merch sales and like; Niji takes the majority, then gives the livers a cut. Honestly, its not much different from the tips that waiters/waitresses and other service workers receive. They are still employees, even if they get the vast majority of their pay from their tips. There is clearly a relationship of subordination and dependence; talents must stream on a set schedule, controlled by the company. They must use equipment provided by the company. They can't work for other companies as Vtubers while employed by Nijisanji (aka exclusivity). Everything they do as livers is controlled and overseen by the company. Their pay is controlled by the company and they specifically can not seek other sources of revenue outside the company's control using the model (which is also provided by the company and they must use that model and not their own).At least the Owozu case did show us that labor law may perhaps not apply to a vtuber-agency work relation because if the talent's salary depends on donations and not on the employer, there is no relationship of subordination or dependence between employee and employer, technically speaking, of course.
The key here is what exactly the Nijisanji contracts promise will be the place from where the talent money salary is going to come from.
