Japanese law has many problems but I'm not sure it's actually more favourable. I've lost track of who is being suggested to sue who over what, but not paying wages or suspending someone without a really solid cause is something the Japanese courts will rule against (although they tend to only award actual damages), and they're not super eager to enforce non-competes.

even for those exemptions she would first have to argue that she is an employee and not a contractor. We're like five arguments deep before she can get her actual case heard.

All of them pretty normal for an employment dispute though? Bad employers put layers of bullshit in their contracts all the time, the court will be used to that and will cut through it. If you could get out of your obligations by incorporating overseas and putting a few lines in the contract, everyone would do it.
