To be fair if it wasn't for the leaks this wouldn't be unusual at all, I'm pretty sure that Denauth is the only wave from EN that's still waiting for 3.0 brushups. If Niji management was actually aware of this shit I think Twisty would've already been ultra killed for daring to avoid the Riku tax, even Phase doesn't let their talents pull that kind of stunt. In the past month she has probably earned 100x her Niji income from her throne account thanks to her skilful whale herding manoeuvres.

Queue the "Twisty has been fired for breach of contract" statement from Niji, confirming everything said here. It's the dumbest move they could do so naturally that is what they will choose to go with.

I don't think it's the dumbest move if the leaks are genuine. If anything it's the smartest move since it demonstrates to other talents that this sort of leaking won't be tolerated. Remember that Hololive fired Yozora Mel earlier this year for leaking despite her having been with the company for over five years and having almost 900k subscribers at that point.

In fact I think that if Twisty doesn't get fired over this, it's further evidence that NijiEN's management is mostly out to lunch at this point.

I don't think we know that for sure about Phase. IIRC Pippa had a Throne open under her Yuni Luna persona for quite a while until she basically closed it herself out of guilt. I know we speculated that donations getting around Fishman was a part of Yuri's termination initially but given what she and others have said about it I no longer believe that had anything to do with it. I'm guessing that unwritten policy, if not written policy, is something along the lines of "just don't do it openly under your PC persona."

I generally buy the rrat that Cover fired Mel as a matter of its reputation to its actual and potential partners - but when faced with an outwardly similar situation, Anycolor did not feel the same pressure, or if they did, they chose not to respond in the same way. Then again, that was a no-win situation of their own making, and Twisty isn't Luca. It could go either way.

Nope, if we assume they play by the rules, niji were only able to keep Luca because they had some NDA with Raziel, so they're kinda in the clear. Even though they sent crump&dump after she removed the docs.
This is how jap court practice is, is company don't fire someone for any contact violation, they effectively annul this clause is all of their contracts. In this case, any and all NDAs.
If they fire someone over NDA in the future, this employee/partner can pull the previous case of willful non-enforcement, sue them and win.
But anykuro CEO and legal department are retarded imbeciles, so who knows what they're thinking.

Cover probably has an internal legal team that took one look at what Mel did and realized they have to fire her or else it opens them up to a major lawsuit due to selective enforcement. If they later terminate someone else for an even worse and potentially malicious leak, the terminated party could sue if they found out Mel violated the contract as well but wasn't terminated. Hell, the menhera retard might have finally had a successful lawsuit if she found out that Mel leaked as well but wasn't terminated, regardless of whether it was intentional nor a severe offense.

Anycolor is probably too retarded to realize that Twisty's leak is very similar to Luca's leak and if they fire her due to a violation of a stipulation in her contract that is present in Luca's as well, they just set themselves up for a lawsuit. Or maybe they do realize this and that's why they haven't fired Twisty yet.

I seem to recall Nintendo's reason for being so litigious regarding their IP isn't because they're malicious assholes (they are) but because something about Japanese legal practice causes their ownership to become void if they selectively enforce it and supposedly they've been burned in the past for this.

It's not just japan, it's trademark in general. If you don't protect your trademark in some country, you lose exclusive rights to it there. Scale of the violation doesn't matter, the fact of past knowing non-enforcement do.
i.e. Mercedes is not a copyrightable word (unlike Nintendo), so if chinks decide to make Mercedes car brand, germans will have to go protect their brand name in chinese courts at all costs. And every country chinks tried to export it to.

Just looked it up. It was Universal trying to sue Nintendo for trademark infringement of King Kong with Donkey Kong. Nintendo was just a small Japanese company against a media giant in the foreign American courts, so everyone expected Nintendo to lose. However Universal had accidentally lost their rights to the King Kong IP and Nintendo won the lawsuit. Ever since then, Nintendo has made sure it never happened to them. The lawyer that won them the lawsuit was John Kirby, the namesake for the Kirby character.

The main difference in these situations is that Cover still had plenty of goodwill at the time they fired Mel so people were willing to spin the story charitably in their favour. Nijisanji does not have this. They demonstrated when terminating both Zaion and Selen that they will act with pure, unrestrained malice if they dislike someone, so if another termination were to occur for any reason, the general public would immediately assume the company are in the wrong once again.

The Twisty leaks suggested that the company are scared to discipline the talents for fear of bad PR, and the fact people like Enna and Ver have been flouting their expected conduct by being openly chummy with Quinn backs that up. Nijisanji have put themselves between a rock and a hard place - if they don't enforce their rules then those rules may as well not exist, and the state of their business depends solely on whether one of the talents feels like dropping a turbo-yab that day; if they do enforce their rules and punish rulebreakers then the media circus will absolutely crucify what's left of their reputation. They can't even do the ol' faithful tactic of giving unwanted talents soul-crushingly mundane work to waste their time until they leave of their own accord, because they'll still end up with a massive platform from VShojo to tell everyone about what happened.
