I'm reminded of that college student in Michigan who got fucked over by an Instagram joke about his rifle, the state appellate court literally ignored Supreme Court precedent on the definition of imminent from cases like Brandenburg v. Ohio and all of his context of that joke, denied his appeal.

Rekieta actually interviewed the kid on his show at some point but I can't find it now.

The post was his gun and something along the lines of "Going to make snowflakes melt" and he made a follow up post that he wasn't making a threat, but rather he thought him having a gun would trigger people. This was in a private group and someone oversaw it that had an issue with him and reported it, and the person later stated they weren't scared of him.

He got busted because he checked the gun into the school armory as they have shooting programs, so he didn't have the gun on him when they arrested him, it was literally filed and in possession of the school.

And if you really want to know how retarded things get, during the interrogation, the detective asked him "Have you seen the Wizard of Oz? What happened to the Wicked Witch? And when she melted, she died, right?"

And that was used as evidence in the case, because the Wicked Witch melted and died they tried to claim he was making a threat to kill people. That's Chewbacca Defense levels of stupid to put a kid in jail for a social media post he confirmed in the same comment thread was not a threat. The kid literally thought he imagined that part of the interrogation because it was stupid until he saw the recording of it again and realized it was real.
