Seriously, I just finished it and said this to my brothers (no specific spoilers, but complaints about the overall everything):

That kinda sucked. S1 was all about the characters and their motivations and their emotions and yadda yadda. Vander trying to protect his kids, Powder trying to help (and failing constantly), Silco trying to elevate Zaun to be equals with Piltover but not being willing to give up Jinx as his daughter in order to do it, Jayce's and Viktors ambition, etc.
And this was just kinda like everyone doing random stuff and random junk happening woosh woosh with hardly any rhyme or reason to it.
Much more of a 'make it up as you go along' feeling, like an 8 year old telling a story; "and then this happened and then this happened and then this and then and then they did that and then they..." but it doesn't really make much sense.

Unless it's an incredibly retarded filian situation, she owns the copyright on her design (you don't need to file anything for that, you could literally scribble something on a piece of paper right now and guess what you own the copyright on that doodle) and if she wanted to really be a bitch about it she could already go after the plushie maker for statutory damages.
I don't think the community would support that, and even after lawyering up and getting a court judgement I don't know that it would be practical to collect, but legally she's 100% in the right here. Just because some Japanese companies have a tradition of tolerance doesn't mean that's binding on other people around the world.

If I want to create art of her borderline femboy self getting fucked I'm in my right to because she has no legal say so and it would just be morally right for me to not do so. If she wants to integrate outside of her discord hugbox, she has to follow the community "rules", and rules dictate vtubers tend to get fanart, fan merch and even fan creations like animations usually without permission and they usually make money on it, but it circles around to you being more known and sought after.

This seems to be a common misconception, since it's so widespread and normalized in the vtubing community. I'm not a lawyer, I'm certainly not a copyright lawyer. I'm just a layman trying to understand copyright laws. However, I'm going to do my best to outline the situation as I understand it. If someone else is more informed on copyright law, they're more than welcome to correct me.

• Nearly all countries are part of the Berne Convention. This agreement dictates how copyright, aka ownership of art that an artist creates, is treated in any country that's part of the Berne Agreement (Wikipedia link for a simple summary)
• As a flip, Gumpai is part of the Berne Agreement. It's extremely likely you're probably part of the Berne agreement too, and so are nearly all the other people on this forum.
• While I can't say what sort of right Gumpai has over the drawing of her character itself, or its rigging (that would be between her and her artist and rigger) she definitely has rights regarding everything else about the character - voice, behaviour, personality, stories involving that character, and so forth.
• Protection for a work exists the moment it is written or recorded. You don't need to apply for paperwork for that work to get copyright. The fact that her streams are recorded by her is enough for her to have copyright and for her to have the rights associated with having copyright
• Among the rights as someone who has created a piece of art is "moral rights", you have the right to object to someone mutilating or deforming your work in a way that impugns the author. If you want to draw lewds of Gumpai, Gumpai could legally object to it based on you impugning her character
• You also have the right for how your work is adaptated and arranged. I think this is the part of copyright law where fanart is technically illegal, but this is something not enforced because it's bad press and because fanart helps drive interest in a property. But if an copyright holder wanted to clamp down on fanart, I do believe they are well within their rights to do so.

As I said before, though, this is a layman's understanding of copyright. Someone feel free to correct me.

Controversial take time: Gumpai has some right to say how her IP gets used. If she doesn't want bootleg merch that she doesn't get any money from, she should be able to say she doesn't want it, and she should be able to post on social media that she doesn't want it. I don't feel like that's brigading.

Of course, this is a retarded position for her to take, and goes against all social norms in the vtubing community, but she does have some legal basis to dictate how her IP is used.

What I said has nothing to do with that beyond Don't say something retarded and then refuse to apologize which is giving the green light to RETARDS to continue their harassment campaign.

I don't think that's the case in all jurisdictions - the point of the minimal moral rights in the Berne convention is that you can't defame the author by mutilating their work and passing it off as the original work (e.g. adding a bunch of slurs to a novel or something, and leaving the original author's name on the cover). But of course your unauthorised fanart would still be copyright infringement.

Every other vtuber knows about fanmerch, knows they don't get a cut but is absolutely delighted to find out it exists. Some of them even intentionally buy it just to have as a symbol of their fans appreciating them. Fanmerch has to be even rarer for non corpo vtubers that aren't Doki.

My take about the Gumpail deal is that because we are operating with japanese mentality here, people outright assume and allow fan merch because is a good way to get promoted, just look at Kusa twitter with people yearning for someone to ask for plushies of them, the problem with the Gumpai case is that even if she was 100% on her right, demanding the plushies to sell it herself while shilling her Uwumarket was the worst move she could do, not only she burned all goodwill but also deterred everyone to even bother to do something for her that doesnt involve giving her money to watch her ass on the discord
