Until we see legal papers, she has no "right" or legality in any situation. If I want to create art of her borderline femboy self getting fucked I'm in my right to because she has no legal say so and it would just be morally right for me to not do so. If she wants to integrate outside of her discord hugbox, she has to follow the community "rules", and rules dictate vtubers tend to get fanart, fan merch and even fan creations like animations usually without permission and they usually make money on it, but it circles around to you being more known and sought after.

It's entirely within Gumpai's rights, legally and morally, to police how third parties are using her character and IP. Especially once money becomes involved, her position gets a lot of teeth once that happens. Just because it's difficult to crack down on fanworks and bootleg outfits and the fact that opinion has generally softened to make challenging them rare doesn't make that go away.
Gumpai should have framed herself better however. Making public seethe posts about Kusa was not the approach to take to resolve any problems she had and could only have left her looking like the bad guy. The whole thing has been stupid and unnecessary.

If Gumpai had brigaded people she didn't like to harrass them, get them fired from their jobs, lose sponsorships and so forth, I wouldn't care if the same thing happened to her. She'd just be living by the rules she'd set for other people. But Gumpai didn't do any of that, so trying to perform cancel culture strategies against her just because we don''t like how rude she was to someone selling bootleg plushies, feels like some incredibly gay shit.

This all started because instead of DMing Kusa about the merch or just banning them, they went straight to doing a twitter callout post to try to get people to dogpile on them while misrepresenting the situation. I'm against cancel culture shit but nah, this is a beast of her own making.

Patience is a virtue, she'll get banned on main and her alts. Her Discord hugbox echochamber might get her some followers back but not to the 13K extent she has as of now (and still dropping). Eventually it'll be a nothingburger once her fanbase thinks it's a waste of time being there.

I have a bone to pick with legalities of it. Policing fanworks is only available to megacorps who allocate yearly legal budget to pour down that drain (pretty much nintendo only). For everyone else it's completely unenforceable. So i think legislations for fanworks should change, and then explicitly include fanmerch (as fixed small royalty % share maybe). Copyright owners should have less rights and more obligations in general.
