Feel free to shut me down if I'm completely wrong on this, but I've heard some rumblings about Finana crying 20 minutes into a recent membership stream because she was broke and couldn't join Pomu and Elira for their Antarctica trip. The rrat is that she was broke from spending her money on gacha games.

I saw comments liveposting about that member stream and they mentioned she cried about Pomu not going to Japan.
People theorized about the reasons she didn't go to Antarctica and it included money but it was speculation, the reason Pomu gave was she couldn't get permission from her strict asian parents.

There's another comment that's more important:
Feesh basically says she stopped hanging out with people in Niji and IRL because she felt like dramafags were targeting her specifically and she didn't want people to get caught in the crossfire

Someone commented that it's not good to livepost member streams because it gets twisted. Two days later a catalog bait thread with the "Finana cries cuz she broke" rrat got posted and got over 300 posts

There are exceptions that allow you to use copyrighted works (such as criticism, education, and parody) but the fact that you're not making money off something isn't one of those reasons.

It can be relevant to a fair use analysis, but it's only one factor in a multi-factor test.

What if the reason that Mika was excited was not just because they could work together again, but also because she was really exited for Pomu?
What does Pomu love? Idol stuff. What's the best place for that? Holo. Would she have been as exited knowing they both would going to Vshojo?

Nah, vshojo "talent freedom" is just too good of a non-offer to people who have been raked over the coals at their own agency, if I was one of them I would want nothing to do with nips. So a FREEDOMLAND corp which has no drama and everyone except filthy chuds likes is basically a golden opportunity for disenfranchised vtubers.

So I have a question: how hard is it to actually get permissions to release a song cover commercially? Over at Phase Connect, Rie's regularly releasing covers of modern JP stuff from various sources, (which also get released on music streaming services), Lumi's doing plenty of covers, and the other talents are occasionally doing stuff too. Other corps do their song covers too. Since they're being released commercially, and being used in advertising, they presumably have the same legal restrictions that Nijisanji talents are required to adhere to. Is there any legitimate reason why Niji is finding it difficult to release covers while other corps don't?

If we're talking strictly standard cover song recordings, like a band might include on an album, releasing cover versions of songs is less about "permission" and more about licensing. It's a much more sterile process than talk about acquiring permission makes it sound, thanks in part to the Music Modernization Act 2021 which streamlined royalty distribution. A mechanical licence should cover you for international streaming, downloads, and CD/vinyl releases. This is even simpler with the advent of specialised music distribution services like DistroKid that provide tools to acquire the necessary licence(s) during the Spotify/Apple Music etc. submission process.

That being said, there are some factors that work differently for VTuber covers to consider. A lot of VTuber covers tend to be strictly vocal covers, using the instrumental tracks from the official release. The mechanical licence only covers using the composition, not the recorded audio track, which would typically need to be negotiated directly (I've heard horror stories from managers of hip-hop artists who've had to chase up uncleared samples with copyright holders after the song had already been released - if the song is already a hit by that point the record labels who own the sampled performance can get greedy and make absurd demands of 80-100% royalties that they have no option but to accept).

If the cover song is being distributed exclusively through YouTube then, in some circumstances, no mechanical licence or official agreement is necessary. YouTube updated their Content ID system a few years ago to recognise cover performances of songs that have been uploaded to their database, and automatically provide a cut of the revenue to the owner. This is a very informal arrangement so I can see why a by-the-book company like Nijisanji would prefer to have it on paper, but I can also understand why indies or small corpos would just use this - especially if their business objective for their cover songs is just to attract an audience to their channel, instead of to sell records for profit.
