Idol's upcoming talent departures are an example of IP ownership working out, letting the talent and corp come to a mutually beneficial arrangement compared to a graduation. There are probably other cases that we'll never hear about because the negotiations were private.Your example is correct but also exists for corpos, remember Yuri? PC owned that IP and still lost out (on future income). From there the difference is IP vs. monetary damages and PC has Yuri's IP but as far as I know not the money. Can you give an example where an investor recouped their investment by utilizing the IP? I can think of a few where they tanked the value instead.
If you've got a contract that entities you to a share of all income from that IP, that's not meaningfully different from owning a share of that IP. If a talent wants to do a discord session without using their character name or likeness, that's very hard to prevent with any kind of contract - indentured servitude is illegal, and if you want to maintain the legal fiction that the talents are independent contractors rather than employees then you can't have a non-compete agreement. All you can really do is hope that the character and whatever corporate support you offer them makes it worth their while to keep working for you (and if it isn't then frankly why should you get anything more from them?) and be prepared to push the big red button if relations really break down.The contract itself can stipulate where and how the IP earns income relative to the agreement. From there if the contract is broken, maybe discord sessions with simps, then contractual penalties are applied. The more I think about it the less I think IP ownership is worth it.
