So no, this man was not innocent at all as you have ICE, an immigration court, an appeals court, and the government of El Salvador all acknowledging him as a member of MS-13. The Supreme Court does not have the authority to compel the President to bring him back, as he is a foreign citizen in his home country. His home country, El Salvador, does not want to send a terrorist to the United States and the Supreme Court can not compel El Salvador as that is a foreign policy matter. The Judicial branch does not have authority in any capacity regarding foreign policy matters between two nations, that is entirely within the purview of the Executive branch. Their argument that he should be returned to be allowed his day in court is invalid as that already happened in 2019 when he received his deportation order and withholding status. Bringing him back to have another day in court over the same issue would be double jeopardy. The Judicial branch has made the most retarded decision in decades in an attempt to exert judicial review by arguing incorrectly.
