>there is a non-zero chance that Clara did in fact read my Hank Hill ass post and seethed about it
The amount of retardation over this situation is dumbfounding so I feel the need to elaborate:
>Kilmar, a citizen of El Salvador, illegally enters the country in 2011
>ICE finds him and tries to deport him in 2019, where he is given a lawful deportation order, meaning he must leave the country
>immigration judges give him a "withholding of removal" status because he claims rival gangs in El Salvador will kill him since he was with MS-13
>the lawful deportation order means he must be removed from the United States, his only options are El Salvador or any other country that will take him
>the "withholding of removal" status simply prevents him from being deported to El Salvador but he should still be sent to another country
>he is never deported because no other country wants to take a random foreign gangbanger
>Earlier this year, Trump signed an EO that labeled various cartels and gangs as Foreign Terrorist Organizations, which included MS-13
>Kilmar's "withholding of removal" status is now invalid because terrorists are not eligible for this status
>Kilmar's lawful deportation order may now be carried out by deporting him to El Salvador, his home country
>Kilmar's status as a member of MS-13 is outright acknowledged by the immigration courts when they gave him a "withholding of removal" status
>Kilmar's status as a member of MS-13 is also acknowledged by the appeals court trying to prevent his deportation
>Kilmar is sent back to El Salvador and he is rotting in a prison there because he is wanted by El Salvador for crimes he committed there as a gangbanger
Nothing about this was illegal and for all intents and purposes, this was basically an extradition.
So no, this man was not innocent at all as you have ICE, an immigration court, an appeals court, and the government of El Salvador all acknowledging him as a member of MS-13. He is a known gangbanger/foreign terrorist that was in this country illegally and was returned to his home country where he was sentenced to prison by his own government for crimes he committed there. The Supreme Court does not have the authority to compel the President to bring him back, as he is a foreign citizen in his home country. His home country, El Salvador, does not want to send a terrorist to the United States and the Supreme Court can not compel El Salvador as that is a foreign policy matter. The Judicial branch does not have authority in any capacity regarding foreign policy matters between two nations, that is entirely within the purview of the Executive branch. Their argument that he should be returned to be allowed his day in court is invalid as that already happened in 2019 when he received his deportation order and withholding status. Bringing him back to have another day in court over the same issue would be double jeopardy. The Judicial branch has made the most retarded decision in decades in an attempt to exert judicial review by arguing incorrectly.
