If your doing modeling of any kind unless you are LITERALLY bush league your photos are going in something i know even the tiny shows will have a dedicated mag for shilling product/models

Wouldn't it be possible (if the donators were crazy enough), that they could enter into an action against Phase for false advertisement towards a donation goal? Simp's likely wouldn't do that because it would implicate Shiina, but, what if we crossed that road at some point where a company gets into litigation due to this type of result from a donation related stream? Where they don't deliver after months of the money being deposited into their account? Would they be able to hide the identities of the vtubers involved due to the nature of the work or would they be forced to provide that information? Would they just fold and provide the content to avoid the court time?
Anyways, I think it is scummy to promise and not deliver, regardless of whatever it is you are promising. So this situation on principle disappoints me.

pretty sure iff it came down to a lawsuit, posting the porn would be make it go away. Idk how contracting and real names works but if you sue you have to live with your name tied to being a vtuber simp forever.
I don't know anything about the actual process of doing anything legal about it but it does seem like something could be possible. I think PC has made a very minor issue into a bit more by handling it badly. Admittedly, most of Shiina's viewers and donators don't really care about this much, it's a novelty at best. We don't even know if the art style was any good (I think the artist is kinda meh). But I do agree that not fallowing through with a donation goal is bad and something PC should not be okay with. Initially Shiina said on stream that a replacement commission might be made, but in her later discord and twitter posts this doesn't seem to be on the table. Really, I think the best would have been for PC to commission a new work that's specifically what is okay for them and Shiina and not comment on the not-okay animation. But it's too late for that now and I do think the lack of a statement from management and the "no, now shut up" attitude about it is bad. This donathon goal was approved by management. The skeb request was approved by management. Shiina said how embarrassing it was having to show them. Tenma saw the NSFW and seemed to think is was good. There's a few possibilities why they'd cancel it.
1(as stated by Shiina) it's just unflattering, too Gynecologic, it's bad, it's too much and so on. Okay, well it would be in PC interest to make something else that's more tasteful but still NSFW just to satisfy the dono goal.
2 Management is afraid appearance of Shiina in a explicate video violates Canadian Law and so can't be officially released by PC. Understandable but then 1 it shouldn't be show to Tenma and Lia either, it should be wiped off thier systems and again, 2 commission something else and be more specific.
3 PC now decided no official NSFW is allowed for talents. They should really make a statement about this if this is the case.
4 (hopefully not this) Shiina doesn't want any official NSFW. Really if this is the case she or management should explain this. I don't think most of her fanbase cares very much and everyone makes mistakes. It's really understandable if she just doesn't want that image going forward, but it's something that should be addressed.
Basically, regardless of the reason, because it was donathon goal, it's in PCs interest to address it in some way. Shiina saying "no, talk to my manager" should not be the remedy. Extra scarf raffles are nice but the "didn't fulfil donathon" with hang over her and PC and sets precedent that PC may not fulfil it's stuff (which is okay, just not great for them).

IIRC she exceeded all her goals by a lot. I think the top 10 donators all got a scarf and other donators were entered into a raffle to win one of 10 additional scarfs.
Like you said an official statement should be made, and deflecting and/or neglecting to produce "the goal incentive" in some way is what seems most egregious here. It is a stain to not fulfill a goal which was incentivized. I don't think she or any phase is against nsfw art, and as an artist herself she knows the effort that it takes, so I can't see her taking a negative stance on it.
Whether it is denied based on law or just perspective should be clarified but regardless they should have known what they were signing off on.
Ultimately, maybe the whole of the crowd won't care but it does have the makings to give lingering doubts towards management and further donothon rewards which would be nsfw in nature.

She also recorded herself (just audio) in the act and wants to release it, but because her paid content is being leaked everywhere (wow surprise), she "doesn't have the courage to post it yet". Read as: waiting for more paid fantia subs and pity replies on twitter before releasing it anyways.
There are plenty of reasons why they would not want to release a full on PORN VIDEO of one of their talents from Shiina's POV Embarrassment is probably the sole reason why she does not want it out on the internet and showing it to her friends and colleagues is far different then a horde of angry simping fans
on the fishman side. Damaging their name among ALL potential partners damaging Shiina's name and brand among all potential partners one or the other is most likely. it's not a full on porn ban (why would it be?) its the same reason twitch and youtube theoretically don't allow porn videos on their sites it scares away sponsors and collaberators even if they are ok with it their sponsors and collaberators might not be.
Oh I agree completely, there's very good reasons to not do cartoon PORN VIDEO. But they chose and approved it for the donathon and approved the skeb request, describing mating press and more. So for them to just not want to now, there should be an explanation, particularly if it's from management or Fishman.
If it is just Shiina's wish, then I feel sorry for her as that's a tough spot to be in. It could be good for her to just say it, but I understand not wanting to. Like I said in another post, I could see how she may have gotten carried away with zug zug at time and then came around to regret it.
Another thing, she mentioned two times on her stream from a couple days ago that she already commissioned another less NSFW skeb. But in her later posts she didn't mention this part. Unfortunately she doesn't want to talk about it anymore so I don't know if that's coming too of if "management said no " means no to that too.
